Welcome to QVR Terms of Use (“Terms”). These Terms apply to your use of QVR and the services offered through our Platform. The Platform includes our website(s), mobile application(s), digital services, and any programs operated by QVR.

Please read these Terms carefully before accessing or using the Platform. By accessing or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all the terms and conditions herein, please do not use the Platform.

1. Scope of Terms

These Terms apply to your access and use of QVR website(s) and/or mobile application(s); any digital or physical product or service provided through our Platform(s); and promotional campaigns, rewards, or membership programs.

2. Eligibility

You must be at least eighteen (18) years of age, or have the consent of a legal guardian, to access or use the Platform. Certain services—such as prescription medication purchases, or digital health consultations—may require additional verification or be subject to further restrictions imposed by applicable laws.

3. Privacy and Data Protection

Your privacy is extremely important to us. In accordance with the PDPA Amendment 2024, all personal data collected through the Platform is processed in compliance with applicable legal requirements. By using the Platform, you consent to the practices described in our Privacy Policy, including the processing of sensitive and biometric data.

4. Use of the Platform

You agree to use the Platform only for lawful purposes. You shall not engage in fraudulent activity, upload viruses, or attempt unauthorized access. We reserve the right, at our sole discretion, to restrict or terminate your access if you violate these Terms.

5. Product and Service Information

All product descriptions, pricing, and availability are for informational purposes only and may change without notice. We do not warrant the accuracy of such information and reserve the right to cancel orders in the event of inaccuracies or stock limitations.

6. Promotions and Campaigns

Promotional offers and discount codes are governed by specific terms. We reserve the right to modify or cancel any promotion without prior notice. Promotional offers are non-transferable and have no cash value unless explicitly stated otherwise.

7. Membership and Loyalty Programs

Participation in our membership or loyalty programs is subject to eligibility criteria. Rewards and points may expire or be forfeited at our discretion. We reserve the right to amend or terminate any such program without liability.

8. Fraud and Abuse

We actively monitor Platform transactions for abusive or fraudulent practices. In cases of suspected misuse, we reserve the right to cancel transactions, terminate user accounts, and report the matter to relevant authorities.

9. Intellectual Property

All content, logos, and trademarks on the Platform are owned or licensed by QVR and Quantum Upstream Sdn Bhd. Reproduction or distribution of any content without our prior written consent is strictly prohibited.

10. Our Obligations

We undertake to ensure information accuracy and employ robust security measures in line with PDPA Amendment 2024. However, we do not guarantee uninterrupted access or absolute security of the Platform.

11. Representations, Warranties, and Indemnity

We disclaim all warranties, express or implied. You agree to indemnify QVR and Quantum Upstream Sdn Bhd from any claims arising from your use of the Platform, breach of these Terms, or violation of applicable laws.

12. Limitation of Liability

To the fullest extent permissible by law, QVR shall not be liable for any indirect or consequential damages. Our total liability will not exceed the amount you have paid for a specific service.

13. Force Majeure

We are not responsible for any delays or failures in performance caused by events beyond our reasonable control, including natural disasters, internet outages, government restrictions, or pandemics.

15. Governing Law and Entire Agreement

These Terms are governed by the laws of Malaysia. Any dispute shall be resolved exclusively in the Malaysian courts. QVR reserves the right to revise this document at any time, with changes effective upon posting.
